To hell with pleasantries, I’m not entirely sure how this works, but from all technical standpoints some 50% of all Manga, Hentai and Anime, or anything else That has to do with this particular jeanery. Must have to a cretin degree, a since of perversity to it.
In all some of this must be considered loli. Almost all of the girls in these stories are between the ages of lets say 10 - 25 years of age, that seem to fall in love with the 30 - 45 year old " stud Muffin / pretty boy " or something simmler to those lines.
This is from an all inclusive standpoint but Could you not consider this loli? and if so then why have they not seen this sooner and put some sort of stopgap on all manga or anime in which this takes place in the entire U.S the U.K. and every other major country in which Anime is sold to or seen by the masses.
"mind you this is just from an outsiders prospective and my opinion dose not literally reflect nor dose it prove anything tord the thinking of any one group of people"
Your biggest problems will come up with; one: jurisdiction, I mean we are spread across the globe like this it usually falls into some obscure treaty no one has heard about, but even that you'll number two: US Codes: Title 18 Part 1 Chapter 71 § 1466A and Chapter 110 § 2256. You should be fine what with the fact that none of the pictures were intended to look like actual persons but what with the 2006 changes to chapter 110 it is a bit stickier than it once was.
If you can find a good lawyer, as far I can tell an affirmative defense under Title 18 Part I > Chapter 110 > § 2252A should protect you and everyone on it. I suspect there are a number of First Amendment groups will be willing to help out a legal defense. If your Webhost tries to censore you, it would seem a fair arguement that they are doing so to avoid the punishment of the law, and that when fear of punishment causes premptive censorship there is a "chilling effect" see William J. Brennan's opinion on Lamont v. Postmaster General.
I should say I am not a lawyer, just a guy who cannot forget all the random shit he hears; and this is all a laymans understanding of the law and should not be taken without a first consulting a lawyer.
Best of luck you. I believe full heartedly in the 1st amend. and while defending lolicon and shotacon are not my first choice, I am willing to beat the hell out of others (my religion won't let me kill under any circumstances) and die to protect the freedoms my forefathers fought and killed for (surprisingly they all did the killing not the dying).

I mean I am from England and well I think its ridiculous how this has all happened. First of all most sites on the internet with 18+ content rely on pure honesty of people by asking for a d.o.b. I mean stupid... and to be honest your stuff was all there for anyone to just see which I disagree with so I can understand people getting angry or mistaking it as child porn. Yes we all know this is wrong but so are alot of other things that America blantantly let slip by. Im quite saddened by this whole thing but in fairness the site should have been more secure so that you could show that to your webhosts. Im not even sure how that works >> Gosh what a problem. ><
We don't have a splash page because we don't have any 18+ material located on the frontpage. If you drop by our site, you have ample time to figure out that we are a porn site. Even the name should tip you off. My *Incest* *Hentai* (read: Porn).
To date, we do not advertise this site in the general public. The way most of our visitors find us is:
(a) They were told about us on another hentai site
or
(b) They decided to type "incest hentai" into google. We're the #1 result.
At the point in which you type 'incest hentai', you clearly know what you're looking for and can't hold anyone to blame when you really do find a site choked full of incest hentai.
--------------
In any case, fairness is no real defense here. We're not being accused of hosting CP. We're being accused (rightly so) of having content that could be deemed obscene by a judge.
Okay. So all the shota and loli content are gone. What's the next move? Will the site still stay up even tho 75% of the manga was lost? What's gonna happen to all the removed content?

Tbh it kind of sickens me that there are so many ungreatful assholes commenting this. Yes it's sad that we can't watch loli here anymore, but really you should praise these guys for hosting it in the first place, since even then it was(and i'm sure they were aware of that) as illegal as it is now. Big thanks to you guys! I hope you atleast keep the non-loli/shota up for a while longer, there are still people who appriciate the work you have done=)
and btw if you guys want a good tip on a loli doujin that's easy to find(and was hosted here for a while) it's called perverseness. My all time favorite(duh it's my screenname=P)
(Copied from another reply) It violates an obscenities clause of an obscure and new law. Considering that it should be no surprise that this 'grey-area' situation lasted so long.
If we had known in the past of this law, loli would have never been allowed here.
two things might have lead to the outage you saw: one of them is the fact that there was planned downtime schedules while the staff worked on optimzing the sites hardware to make the site function faster.
The second, with the removal of Loli and Shota manga, which was 3/4ths of the entire site, there's big huge gaping holes in the database, which might be leading to instability in the database, causing 503 errors, which I have been getting every other page I click on the site.
Ah, well. It was good while it lasted. Thanks for the memory, or something. It WAS technically child porn, I suppose. It's not really something you can say you liked for the storyline, anyway. I wonder what Britain says about this kind of thing... Laws are no fun when it's like this.
Now that I think of it, couldn't the same logic behind banning lolicon be used to ban any kind of violence in videogames? Yet no-one in their right mind would try to ban videogames. Which would suggest that people don't have a problem with lolicon, they just think "Ew! Something like child porn! Bad!" But, we already knew that.
Of course, I'd be astonished if anyone would try to USE this point for anything without a good degree of anonymity. So, y'know, we're fucked. Shame.
Because unlike what you think, they have been and are attempting to ban any violence in video games. They are in the courts over every violent video game and every school shooting trying to get the games banned... Counter Strike, Grand Theft Auto, Man hunt, etc.
Don't blame the Staff for complying with Laws. And Oniichan, seriously just start ignoring them. It appears to me that the majority of these posts are by under-educated children/crack addicts who can't read or type. You are simply wasting your time in even replying to the obviously stupid posts. Thanks for all you have done, but definately don't risk jail over something so stupid.
In some cases... I'd agree, but here I think people are just 'traumatized' over the loss so I can't blame them for being so outspoken.
I just want to remind everyone that, despite it all.. its not our fault. The law really gives us no leeway.
I remember when Hentai-Key was forced to shut down over this same issue. Rather than quote the law or talk in specifics, they simple laid blanket blame on G.W. Bush and said 'America is a tyranny rules by idiots'.
I'd like to take a different stance so people can know what they *can* do to help change things for the better, or else in the years to come we may see all the lolicon sites move to russia and the the entire idea lose legitimacy in the states. Act now while the law is fresh because once it become precedent, judges will hate to modify it even an iota.

Hongfire was challenged once, because of the loli images, manga and games.
Their entire site went down for almost a month thanks to some agent. They challenged it and won. I suggest you contact their webmaster about the details, cause he posted all info during the downtime.
Hongfire was challenged under the 502 clause.
We're being challenged under the 504 clause.
While we were prepared and ready to fight any 502 challenge (as that was the part of the Protect Act we knew about), we had no idea that 504 act even existed. However reading it, I would say it is very difficult to mount a challenge against it.
Last year Over at DAtorrents.com and Hongfire.com (Datorrents being hosted in Canada, and Hongfire in the US) removed their loli sections (Which put this entire site to shame with how much stuff both sites have in their sections) over a bill that was signed by Pres. Bush making comic (Drawn) images (EG loli and other stuff) the same as child porn. The law never made it through congress and was never enacted on grounds that it violated free speech and didn't harm children in anyway. Both sites brought their galleries back online with in 2 or 3 weeks.
I can pretty much guarantee that those other sites that were brought down was because some child advocacy group contacted their Host and scared them with the Child Protection Act of 2003 and got them to take the sites down.
Show me a recent news article or government page saying that a new law has been passed in the US or Canada saying that such images are illegal and I'll believe it, otherwise, the staff on this site just got smacked with the stupid stick.
If this is about a law that might be passed in Japan (I saw something on a google search I was doing while writing this comment, and didn't bother to look at the date the article was posted, so I might be wrong) about banning Loli art, let me remind you that a country can not force citizens of another country to follow their laws. Meaning The US cannot force a Canadian to follow its laws. Prime examples of this is the MPAA and RIAA trying to shut down The Pirate Bay.
If you only read section 502. You'll think that lolicon is allowed, since it is specifically excluded from being "virtually indistinguishable" from a minor. However in 504, obscene content including artwork is re-included in the ban.
To date, only the 502 section has seen any news time and is the only thing being challenged in courts. The reason being is that 502 carries stricter penalties since it labels content as child porn. Violate 502, and you become a sex offender for life and get guaranteed jail time.
Violate 504, and you've merely violated an obscenity regulation.
----
Note: This is US law, and we must follow US law because: (a) the servers are located in the US, (b) most of the users are US citizens and (c) the staff is located in the US.
----
If the entire 2003 Protect Act has been nullified or specifically section 504 has been nullified then please give post a link to a reliable source so we can prepare a defense on that basis.
obviously you didn't read what I said (Bush Signed a bill that didn't Make it past congress... Bush and his staff made the law).
And also, if you read the entire section it states:
"(B) lacks serious literary, artistic, political, or scientific value; or attempts or conspires to do so, shall be subject to the penalties provided in section 2252A(b)(1)."
The government doesn't get decide what is art and what isn't, art falls under Freedom of speech and expression under the First amendment. The day the government (in my case, the government of Canada, which by the way, doesn't have any law against Loli or anything like it) tells me, an artist (http://www.aceman67.com), what is art and what isn't will be the day I bloody well die.
Hentai manga and anime made in japan is a serious literary and artistic venture. People make their living and help run entire industries off it (two of these industries are Book Publishing and Paper manufacturing).
The Japanese pornography industry is second only to its United States counterpart.
saying the canadian gov't doesn't have any laws against lolicon is absurd, everyone knows loli is completely illegal in canada, and there are even cases in which people in it's posession have been successfully prosecuted and convicted, jailed and fined for posessing, importing, and sharing it. aceman, i suggest you read up on your countries laws, ASAP.
Canadian law is wierd. It states that since we can't know what age the characters are just by looking at them, we have to go by what's specifically said.
So if the characters say they're 20, it doesn't matter if they look like toddlers.
If you actually read the loli/shota previosuly hosted, you'll see that's pretty much impossible as well since imagined character ages are stated in text.
now, I've already mentioned Hongfire.com, but what I didn't say (And anyone who frequents the site knows that they had their license pulled last year at Christmas time (Christmas eve to be exact).
The lawyer representing vBulliten (A british company) whose job it was take care of people stealing the software (Which was hired as a 3rd party), read the Protect Act of 2003, and yanked their license on the grounds that the website was violating it. Fighting this, Hongfire sent a response (Pretty much what was said here: http://www.hongfire.com/forum/showthread.php?t=42579) to vB (Not the lawyer), and they reversed the decision, and it was in the opinion of vb's lawyers that US law wasn't being violated.
Thanks. We've already been in contact with all hentai webmasters previously charged under the Protect Act, and asked how they fought it off (if at all).
There are two different clauses of the Protect Act that hentai sites can be charged under.
- The 502: ban against virtually indistinguishable CP.
- The 504: obscnity clause
The 502 clause does specifically exclude artwork from its scope, however the 504 *specifically includes* artwork under an obscenity ban.
Fighting an obscenity ban is extremely difficult since the definition of what is 'obscene' is purely subjective. One judge may agree, another may disagree and the case could be in and out of court for years.
To date, anyone who has been charged under the 504 clause of the Protect Act has simply removed the offending content forever.
aceman speaks the truth! the problem is he left out a crucial detail. while the gov't doesn't decide what is artistic or not, a judge may decide if said "art" is obscene or not. and once something is deemed obscene, it's no longer constitutionally protected free speech, and you can be prosecuted for it. furthermore, buisnesses like our hosting company reserve the right to judge if our content is obscene or not, just like they reserve the right to drop us from their servers at any point in time for no reason. the hosting company is covering it's ass in regards to things like lawsuits. they could have just erased the site from existance, but since we've been giving them money (and alot of it) for 2+ years, we were given some leeway, and time to remove the content.
1/ anyone who works with computers there speaks english better then the avarage mexican/non british european/arab/japanese/
2/ if you find a hosting company outside moscow, you'll find the prices acceptable.

http://www.hongfire.com/forum/showthread.php?t=42579
Congress makes laws, not the
Congress makes laws, not the president. In order for the president to sign a law, it has to be passed by both houses of Congress first.
The 2003 Protect is standing law. Please read section 504.
http://judiciary.senate.gov/special/S151CONF.pdf
----
If the entire 2003 Protect Act has been nullified or specifically section 504 has been nullified then please give post a link to a reliable source so we can prepare a defense on that basis.

obviously you didn't read
obviously you didn't read what I said (Bush Signed a bill that didn't Make it past congress...
The Japanese pornography industry is second only to its United States counterpart.
also
saying the canadian gov't doesn't have any laws against lolicon is absurd, everyone knows loli is completely illegal in canada, and there are even cases in which people in it's posession have been successfully prosecuted and convicted, jailed and fined for posessing, importing, and sharing it. aceman, i suggest you read up on your countries laws, ASAP.
Canadian law is wierd. It
Canadian law is wierd. It states that since we can't know what age the characters are just by looking at them, we have to go by what's specifically said.
So if the characters say they're 20, it doesn't matter if they look like toddlers.

great law!!!!
hey thats great!
so then just find a Canadian webhost and let all the loli and shota state they are 20 and were back on busyneesss man!!!!!!!!!!!!!!!!!!!!!!!!!!
If you actually read the
If you actually read the loli/shota previosuly hosted, you'll see that's pretty much impossible as well since imagined character ages are stated in text.

Because you're Canadian,
Because you're Canadian, I'll forgive your ignorance but in the American system the executive branch (this is Bush) is forbidden from creating law.
Law comes from the legislative branch. *All* Bills must pass through both houses of congress before the President even gets a chance to sign it.
He can veto it, but he can't sign a bill before it has been passed by Congress.
If you need to know more about the American legal system, please read Wikipedia.

now, I've already mentioned
now, I've already mentioned Hongfire.com, but what I didn't say (And anyone who frequents the site knows that they had their license pulled last year at Christmas time (Christmas eve to be exact).
A year later, the site is still running.
Thanks. We've already been
To date, anyone who has been charged under the 504 clause of the Protect Act has simply removed the offending content forever.

orly part deux
aceman speaks the truth! the problem is he left out a crucial detail. while the gov't doesn't decide what is artistic or not, a judge may decide if said "art" is obscene or not. and once something is deemed obscene, it's no longer constitutionally protected free speech, and you can be prosecuted for it. furthermore, buisnesses like our hosting company reserve the right to judge if our content is obscene or not, just like they reserve the right to drop us from their servers at any point in time for no reason. the hosting company is covering it's ass in regards to things like lawsuits. they could have just erased the site from existance, but since we've been giving them money (and alot of it) for 2+ years, we were given some leeway, and time to remove the content.
'Tis a day of mourning...
I hope I can find a way to help you guys. Unfortunately, I'm Philippine-based so I guess trying to do something with foreign law won't do a thing.
I GUESS I MAY HAVE A SOLUTION !!!!!!!!!!!!!!!!!!!!
LETS MOVE THE SITE TO RUSSIA AND/OR JAPAN!!
LOOK THESE SITES (I prefer shota, but I guess "legally" (?) they would be the same than loli):
http://imgsrc.ru/users/brando1388
http://kibachan.suzume.org/
http://imgsrc.ru/main/user?user=kota
PASSWORD=
braves
http://sushiy.com/index.php?page=scans
http://www.ko-chan.org/
russia can be a solution:
1/ anyone who works with computers there speaks english better then the avarage mexican/non british european/arab/japanese/
2/ if you find a hosting company outside moscow, you'll find the prices acceptable.
Can you suggest any Russian
Can you suggest any Russian hosting companies? I'm not familiar with the country.
